Article 1 (Scope of Application)
 
These Terms shall apply to all services (hereinafter referred to as the “Service”) provided by Daikin (hereinafter referred to as the “Group”) on the ‘Daikin WBT’ site operated by the Group.
The “Group” refers to the following Daikin Group’s companies that provide the Services.
Daikin Industries, Ltd. (Japan)
Daikin Europe N.V. (Belgium)

Article 2 (Description of Services)
 
The Group shall provide the user with the learning materials (hereinafter referred to as the “Materials”) necessary to study courses offered by the ‘Daikin WBT’ via the Internet.
Article 3 (Scope of Use)
 
(1) The user shall use the Materials only for the purpose of personal learning.
(2) The user shall not grant the right to reuse the Materials to a third party, nor distribute, sell, assign, transfer, lend or disclose them.
(3) The user shall not edit all or part of the Materials, nor create anything deriving from the Materials.
Article 4 (Course Application)
 
(1) The course application for the Service (hereinafter referred to as the “Application”) shall be submitted by the individual wishing to use it according to the given procedures.
(2) After the Group has approved the Application, a login name and password are issued to the applicant. The Group may reject the Application if any of the following Items apply:
 
1. The applicant has made a false, misleading or fraudulent statement in the Application.
2. The applicant has violated any of the provisions set forth by these Terms of Service in the past.
3. There are obstacles to the Group conducting its work, providing the Service or technically.
4. The Group determines that the applicant is inappropriate in any other respect.
Article 5 (Cancellation of Application)
 
(1) The applicant shall not be permitted to cancel the Application after issuance of a login name and password.
(2) The Group shall be entitled to cancel the Application even after issuance of a login name and password if any of the Items specified in Article 4, Paragraph 2 are found to apply to the applicant. The Group shall cancel the approval of the Application by sending a notice of such cancellation via e-mail and remove the login name and password.
Article 6 (Equipment, etc.)
 
The user shall prepare all the equipment, including communications devices and software, necessary to use the Service under his or her own responsibility and at his or her own expense. Moreover, the user shall use the Service via preferred Internet access service under his or her own responsibility and at his or her own expense.
Article 7 (Management of Login Name and Password)
 
The user shall assume all the responsibilities of using and managing the login name and password issued him or her by the Group. The Group shall not be held liable for any damages or losses incurred by the user resulting from the use of the login name and password by a third party.
Article 8 (Notification of Changes)
 
(1) The user shall promptly notify the Group of any changes to his or her address, e-mail address or any other relevant information.
(2) The Group shall not be held accountable for any problems in the use of the Service by the user arising from failure to comply with the provision stipulated in the preceding Paragraph.
Article 9 (Course Period)
 
(1) The user shall only be permitted to use the Service during the course period prescribed for each of the Materials comprising the Service.
(2) The course period shall be noted on the ‘Daikin WBT’ site.
(3) The course period shall be calculated from the day on which the login name and password are issued.
Article 10 (Prohibition of Assignment or Transfer of Rights)
 
The users shall never assign or transfer the right to use of the Service to third parties under any circumstances.
Article 11 (Use of Registered Information)
 
(1) The Group shall use the information provided by the user upon application or known to the Group during the use of the Service by the user (hereinafter referred to as the “Registered Information, etc.”) for the purpose of providing the Service. Moreover, the Group shall use the Registered Information, etc. for the purpose of providing the user with information on the various other services offered by the Group.
(2) The Group shall not disclose the Registered Information, etc. to any third parties, except when any of the following Items apply:
 
1. The Group discloses collected personal information as statistical data (i.e., aggregate information in which the identity of the user remains anonymous) for the purpose of ascertaining trends in the use of the Service.
2. A user has separately and expressly agreed to the disclosure of limited personal information.
3. Disclosure has been requested by a national authority or other public entity under the laws and regulations.
Article 12 (Prohibitions)
 
The user shall not engage in any of the following activities when using the Service:
1. Activities that may interfere with operation of the Service.
2. Activities that may deviate from the intention of the Service as a whole or the particular courses within.
3. Any other activities that may violate any laws or regulations, be offensive to public order and morals, or put others at a disadvantage.
Article 13 (Disciplinary Measures of Prohibitions)
 
When a user’s activity is determined to fall under any of the Items specified in the proceeding article, the Group shall take measures it deems as appropriate without prior notice to said user, such as the termination of the user status, as specified in the following article.
Article 14 (Termination of User Status)
 
(1) The Group shall be entitled to immediately and forever terminate the user status of said user, without prior notice, if any of the following items applies to a user:
 
1. The user is found to have made a false, misleading or fraudulent statement in the Application.
2. The user has engaged in any of the prohibited activities specified in Article 12.
3. The user has interfered with the operation of the Service in any way.
4. The user has violated any of the conditions set forth by these Terms of Service.
5. The user has been determined to be inappropriate by the Group.
(2) When the Group is to forever terminate the status of a user who is using multiple services comprising the Service according to the items in the proceeding paragraph, all the services to be used by said user shall be subject to the termination.
(3) The Group shall not be held accountable for any damages incurred by a user from not being able to use the Service as a result of the implementation of the aforementioned measures.
Article 15 (Compensation)
 
If a user has caused damages or losses to the Group due to violation of the Terms of Service, he or she shall be held liable for compensation of said damages or losses.
Article 16 (Changes, Cancellation and Interruption of Service Conditions and Contents)
 
(1) The Group shall be entitled to act at its own discretion to restrict access to the Service if deemed necessary based on the monitoring of the use in regards to the operation of the Service.
(2) The Group has created the contents of the Service based on the relevant factors, including the laws, regulations and climatic conditions in the country or region where the Group is located. The user is advised to use the Service with careful examination of the respective laws, regulations, climatic conditions and the like. Moreover, the Group shall not be held liable for any damages or losses, for whatever reasons, incurred by a user as a result of use of the Service contents.
(3) The Group shall be entitled to cancel or interrupt the operation of the Service in the event any of the following items apply:
 
1. System maintenance of the Service on a regular or emergency basis.
2. Force majeure circumstances in which normal provision of the Service become difficult or impossible, such as war, riot, civil unrest, labor dispute, earthquake, volcanic eruption, flood, tsunami, fire or power failure.

Any other circumstances in which the Group determines it necessary to temporarily interrupt the Service for operational reasons.
(4) The Group shall notify the user of any cancellation or interruption of the operation of the Service according to the proceeding paragraph. This, however, does not apply to emergencies.
(5) The Group shall not be held liable for any damages or losses incurred by a user or third party, for whatever reasons, arising from the restriction of the access to the Service or the cancellation or interruption of the operation of the Service.
(6) The Group shall be entitled to change the contents and/or name of the Service without prior notice to the user.
Article 17 (Modifications and Amendments)
 
(1) The Group shall be entitled to modify or amend the provisions of the Terms of Service as deemed necessary and the user shall abide by these modifications or amendments. The modified or amended Terms of Service shall be disclosed to the user promptly on the ‘Daikin WBT’ site.
(2) The instructions and/or provisions notified to the user in the operation of the Service on an as-needed basis shall comprise part of the Terms of Service.
Article 18 (Miscellaneous)
 
(1) In the event of a dispute between the user and the Group regarding the Service, the said parties shall discuss said matter in good faith.
(2) If the dispute in question cannot be resolved through discussions as mentioned in the preceding paragraph, courts in regions where the Group is located shall be designated with exclusive jurisdiction for the first instance.
(3) The Terms of Service shall take effect as of December 1, 2006.
